The Supreme Court of the Russian Federation considered a moral damages dispute involving a violation of citizens’ rights by government authorities

A resident of Altai Krai went to court seeking to have the local administration’s decision refusing to lease a land plot to her without a tender declared unlawful.
In her application, she stated that the plot had been allocated and granted to her for use for the construction of a residential house by a resolution of the village administration in 2002, so no lease agreement had been concluded.
When the house was 82 percent complete, she applied to the district administration to have the land leased to her without a tender, but her request was refused because there was an unregistered capital construction object on the plot.
The court of first instance, with which the appellate court agreed, found the local administration’s decision unlawful and granted the claim. Cassation reversed those rulings.
The Supreme Court of Russia upheld the decisions of the first-instance and appellate courts. The Administrative Chamber explained that the failure to conclude a lease agreement in 2022 did not in itself prevent the land plot from being provided for the completion of the residential house, since the work was being carried out on the basis of lawful grounds, namely a decision of the local self-government body.
